Section 202(a) of the Federal Workforce Flexibility Act of 2004 (Public Law 108-411, October 30, 2004) amends 5 U.S.C. 6303 to provide OPM with the authority to prescribe regulations under which a newly appointed or reappointed employee may receive service credit for prior experience that otherwise would not be creditable for the purpose of determining his or her annual leave accrual rate. (See CPM 2004-22, November 1, 2004). The Office of Personnel Management (OPM) recently issued interim regulations implementing this new provision (copy attached).

The U.S. Office of Personnel Management (OPM) has contracted with the International Foundation for Retirement Education (InFRE) to conduct a study on what it means to be ready for retirement. This study will help all of us meet the requirements in the Thrift Savings Plan Open Elections Act of 2004 to educate Federal employees on the need for retirement savings and investment, how to plan for retirement, and how to calculate the retirement investment needed to meet their retirement goals.

On December 21, 2004, the Office of Personnel Management (OPM) notified agencies of the moratorium on processing agency SES Qualifications Review Board (QRB) cases when an agency's head departed or announced his or her departure. The purpose of this memorandum is to provide instructions on how to proceed with QRB cases pending at OPM after a new agency head takes office.

We are requesting your agency's FY 2005 report on the physicians' comparability allowance (PCA) program. We request that you provide this report by May 2, 2005. Section 5948(j) of title 5, United States Code, requires the President to submit an annual report to Congress on the operation of the PCA program. Under Executive Order 12109, the President has delegated responsibility for administration of the PCA program to the Director of the Office of Personnel Management (OPM), acting in consultation with the Director of the Office of Management and Budget.

As you know, Executive Order 13318, signed November 21, 2003, modernized the Presidential Management Fellows (PMF) program. Among other things, it added a new Senior Fellows component to the program, eliminated rigid limitations on the number of new PMFs (Fellows and Senior Fellows), and charged the Office of Personnel Management (OPM) Director with determining the maximum number of Fellows and Senior Fellows that may be appointed during any given fiscal year.

Section 209 of the E-Government Act of 2002 (P.L. 107-347), hereafter referred to as the Act, requires the Office of Personnel Management (OPM), in coordination with the Federal Chief Information Officers (CIO) Council, to assess the adequacy of existing Governmentwide information technology training programs and to recommend improvements as appropriate. Additionally, the Act requires OPM, in collaboration with the Council, to issue policies to assist agencies in the development of performance standards for IT training programs.

The National Association of Hispanic Federal Executives (NAHFE) will hold its Seventh Hispanic Federal Executives Summit at the Rosen Plaza Hotel, 9700 International Drivein Orlando, Florida, on April 7-8, 2005. The target audiences for this Summit are members of the Senior Executive Service, GS-15s, and GS-14s. The Summit will focus on key issues of importance to Hispanics in the Federal workforce. As Director of the Office of Personnel Management (OPM), it has been my privilege to promote the initiatives of President Bush, who shares many of NAHFE's goals.

Upon appointment by President Bush in 2001, I have worked closely with Administration teammates across Government to support the President's efforts to increase the hiring of veterans. We should take pride in knowing 25 percent of all Federal employees are veterans compared to 9.4 percent in the civilian labor force. As I prepare to leave OPM, I want to stress the importance of honoring the service of our Nation's veterans by ensuring they receive every opportunity to continue to serve this country in the United States civil service.
